No.20 2023/24 - Notice of Cancellation in respect of non-mutual War Risk Business

The Association has received notice of cancellation from its reinsurers in respect of war risks liabilities arising within the Indian Ocean, Gulf of Aden and Southern Red Sea. As a result, the Association in turn is issuing a corresponding Notice of Cancellation for non-mutual business which includes a war risk extension. This new exclusion does not apply to Mutual P&I and FD&D cover.
Notice of Cancellation is hereby given that, with effect from Noon GMT Tuesday 20th February 2024, the following exclusion will apply in respect of War Risks coverage as set out in the Rules of the Association and/or terms of entry on all non-mutual business including but not limited to;
- Charterer's Liability Cover
- Fixed Premium owners cover
- Non-Poolable extended covers to Mutual entries and Fixed Premium P&I Cover.
Upon expiry of the notice at Noon GMT, 20 February 2024, War Risk cover will be terminated automatically for each Member or Assured, including Joint members or co-assureds where any such liabilities, losses, damages, costs and expenses occur or arise in the waters specifically mentioned below:
Indian Ocean, Gulf of Aden and Southern Red Sea. The waters enclosed by the following boundaries:
a) on the northwest, by the Red Sea, south of Latitude 18°N
b) on the northeast, from the Yemen border at 16°38.5’N, 53°6.5’E to high seas point 14°55’N, 53°50’E
c) on the east, by a line from high seas point 14°55’N, 53°50’E to high seas point 10°48’N, 60°15’E, thence to high seas point 6°45’S, 48°45’E
d) and on the southwest, by the Somalia border at 1°40’S, 41°34’E, to high seas point 6°45’S, 48°45’E
excepting coastal waters of adjoining territories up to 12 nautical miles offshore unless otherwise provided.
The Association is currently reviewing options to allow Members to buyback this exclusion if they wish to do so.
