USA – Right Whale Ship Strike Reduction Rule – Update

In November 2010 the Club published USA – Right Whale Ship Strike Reduction Rule reminding Members to ensure their vessels complied with the seasonal speed limit restrictions in place in certain areas off the East Coast of the United States. The speed limit was set so as to reduce the likelihood of ships colliding with Right Whales. Since the Ship Strike Reduction Rule has been in force, the United States National Oceanic and Atmospheric Administration (NOAA) has regularly been issuing civil administrative penalties against vessels that have not complied with the speed limit.

The legislation entered into force in 2008 for a period of five years and was due to end on 9 December 2013. Shortly before the legislation was due to expire; the “Sunset Clause” within the regulation was removed. Consequently the Ship Strike Reduction Rule now remains in place for the foreseeable future. Members are advised to ensure their vessels trading in the affected areas are aware of the ongoing seasonal speed limit requirements.
